These terms are the agreement between you and us for your use of Human Touch, available at tryhumantouch.com (the “Service”). Please read them before you use the Service. If you do not agree with them, do not use the Service.
1. Who we are
The Service is operated by Wunderlabs S.R.L., a limited liability company registered in Romania, with its registered office at Str. Sinaia nr. 2B, sc. 2, et. 3, ap. 28, Timișoara, Timiș County, Romania, Trade Register number J2026028653008, tax identification number (CUI) 54593071 (“we”, “us”). 2. Who can use the Service
You must be at least 18 years old, or the age of legal majority where you live, to use the Service. If you use it on behalf of a business or another person, you confirm that you are authorised to accept these terms for them.
3. What the Service does
You upload a raw video and the Service edits it for you. Editing is done by automated tools, including artificial intelligence, that apply styles created and selected by our team. This can include cutting pauses and mistakes, adding subtitles, captions, stickers and sound effects, and improving picture and sound. You can preview the result for free and pay to download it or publish it to TikTok.
The edit is produced automatically and can contain mistakes, for example in subtitles. You are responsible for reviewing your video before you download or publish it. We may add, change or remove features, and some features described on the site may not be available to everyone yet.
4. Price and payment
Previewing an edited video is free. Downloading or publishing a video costs 4.99 USD per video, unless a different price is shown to you at checkout. The total price, including any applicable taxes, is shown before you pay. Payments are processed by Stripe; we do not store your full card details.
5. Right of withdrawal and refunds
If you are a consumer in the European Union, you normally have 14 days to withdraw from a contract concluded online. The edited video is digital content that is delivered to you immediately. When you pay, you ask us to deliver it straight away and you acknowledge that you lose your right of withdrawal once the download or publication has started.
You see the result before you pay. If the video you receive is faulty or does not match the preview, write to us at [email protected] within 14 days of your payment and we will fix it or refund you. This does not affect the rights you have by law, including the legal guarantee of conformity for digital content.
6. Your videos
You keep all rights to the videos you upload and to the edited videos we deliver to you. You give us a worldwide, non-exclusive, royalty-free permission to store, process, modify and deliver your videos, only as needed to provide the Service to you.
You confirm that you have the rights and permissions needed for everything in your videos, including the people who appear or are heard in them and any music, brands or other material owned by someone else.
7. Acceptable use
You agree not to use the Service to:
- upload content that is illegal or that infringes someone else’s rights;
- upload sexual content involving minors, intimate content shared without consent, or content that harasses, threatens or incites violence or hatred against others;
- mislead people about who appears in a video or who made it;
- upload malware or try to disrupt, overload or gain unauthorised access to it;
- copy, reverse engineer or resell the Service, or get around payment;
- access it with automated tools, except through interfaces we provide for that purpose.
We may remove content and suspend access when these rules are broken.
8. Publishing to TikTok
Connecting your TikTok account is optional. If you connect it, we publish a video to your account only when you ask us to. Your use of TikTok is governed by TikTok’s own terms and policies, and you are responsible for following them. You can disconnect your TikTok account at any time, from TikTok’s settings or by writing to us.
Human Touch is an independent service. It is not affiliated with, sponsored by or endorsed by TikTok, and we are not responsible for how TikTok handles, ranks, restricts or removes your content or account.
9. Material we add to your video
Fonts, stickers, sound effects and other creative material that we add remain owned by us or our licensors. You may use them as part of your edited video, including for commercial purposes on social media. You may not extract them and use or distribute them separately.
10. Our Service
The Service, including its software, design, editing styles, name and logo, belongs to us or our licensors. These terms do not give you any rights to them beyond using the Service as described here.
11. Availability
We work to keep the Service running well, but we do not promise that it will always be available or free of errors. We may suspend it for maintenance or security reasons, or discontinue it. Keep your own copy of your original videos; the Service is not a storage or backup service.
12. Ending your use
You can stop using the Service at any time. We may suspend or end your access if you seriously or repeatedly break these terms, or if we are required to by law. Videos you have already paid for remain yours to use.
13. Liability
Nothing in these terms limits our liability where the law does not allow it, including for intent or gross negligence, for death or personal injury, or for your statutory rights as a consumer.
Apart from that, we are not liable for indirect losses such as lost profit, lost revenue, lost followers or lost business opportunities, or for the actions of third parties such as TikTok. Our total liability to you for any claim related to the Service is limited to the amount you paid us in the 12 months before the claim arose.
14. Complaints and disputes
If something goes wrong, write to us first at [email protected] and we will try to resolve it. Consumers in Romania can also contact the National Authority for Consumer Protection (ANPC) at anpc.ro and use its alternative dispute resolution procedure, described at anpc.ro/ce-este-sal.
15. Governing law
These terms are governed by Romanian law, and the Romanian courts have jurisdiction over disputes. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim before the courts of that country.
16. Changes to these terms
We may update these terms, for example when the Service or the law changes. We will post the new version on this page and change the date at the top. If a change is significant, we will make it clearly visible before it takes effect. The version in force when you pay for a video applies to that purchase.
